terms of service

by using incandenza ("the service"), you agree to these terms. if you do not agree, do not use the service.

1. the service

incandenza is a generative audio entertainment service. it analyzes your listening history from connected music services and generates personalized, real-time audio streams. the service produces algorithmic generative audio — not music. the output is non-recoverable, stateless, and unique to each listener at the point of reception.

2. accounts

• you may use the service anonymously with limited functionality, or sign in with google for a full account.
• you are responsible for maintaining the security of your account.
• you must be at least 13 years old to use the service.
• we reserve the right to suspend or terminate accounts that violate these terms.

3. subscriptions and billing

• subscriptions are billed monthly through stripe at the rate displayed at the time of purchase.
• subscriptions renew automatically until canceled.
• you may cancel your subscription at any time through the billing portal. cancellation takes effect at the end of the current billing period.
• no refunds are issued for partial billing periods.
• we reserve the right to change pricing with 30 days notice.

4. intellectual property

• the generative audio produced by incandenza is algorithmic output, not a musical work. it is generated in real-time, not stored, and is non-recoverable.
• you do not acquire any copyright or ownership over generated audio streams.
• the incandenza name, logo, visual identity, and software are the property of deux collectif.
• you may not record, redistribute, or commercially exploit the audio output without written permission.

5. connected services

• incandenza accesses your data from third-party music services (youtube music, apple music, last.fm, tidal, spotify) only with your explicit authorization.
• you may disconnect any service at any time.
• we are not responsible for changes to third-party service apis, terms, or availability.

6. acceptable use

you agree not to:

• attempt to reverse-engineer, decompile, or extract the audio generation system.
• use automated tools to access the service at scale.
• share account credentials with others.
• use the service for any unlawful purpose.

7. availability and warranties

• the service is provided "as is" without warranties of any kind, express or implied.
• we do not guarantee uninterrupted or error-free operation.
• the generative audio output may vary in quality and character. this is inherent to the generative nature of the service.
• we reserve the right to modify, suspend, or discontinue the service at any time.

8. limitation of liability

to the maximum extent permitted by law, deux collectif shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, loss of profits, or interruption of service.

9. copyright claims

if you believe that content generated by or displayed on incandenza infringes your copyright, contact legal@incandenza.io with:

• a description of the copyrighted work.
• a description of the allegedly infringing content.
• your contact information.
• a statement of good faith belief that the use is not authorized.

10. changes

we may update these terms from time to time. continued use of the service after changes constitutes acceptance. material changes will be communicated via email or notice on the service.

11. governing law

these terms are governed by the laws of the jurisdiction in which deux collectif operates, without regard to conflict of law principles.
